General Terms and Conditions (GTC) of Skydive Mission

Part 1 – General Section (applies to all business areas)

1 Scope of Application and Definitions

  1. These General Terms and Conditions (hereinafter referred to as the “GTC”) apply to all contracts concluded between

Skydive Mission, Owner: Chris Nickel, Rosa-Luxemburg-Straße 42, 03238 Finsterwalde, Germany
(hereinafter referred to as the “Provider”)

and the customer via the website www.skydivemission.com or by any other means.

  1. These GTC apply both to consumers within the meaning of Section 13 of the German Civil Code (BGB) and to entrepreneurs within the meaning of Section 14 BGB, unless expressly stated otherwise.

  2. In addition, the special provisions contained in Parts 2–4 of these GTC apply:

  • Part 2 – Special Conditions A: Travel, Training & Courses

  • Part 3 – Special Conditions B: Tandem Jump Vouchers

  • Part 4 – Special Conditions C: Product Sales & Maintenance

To the extent these special provisions contain more specific regulations, they shall take precedence over the provisions of this General Section.

  1. Definitions:

  • “Customer” means any natural or legal person who makes use of the Provider’s services.

  • “Services” include, in particular, skydiving services, tandem jumps, training, photo and video products, as well as the purchase of vouchers.

2 Contracting Parties and Conclusion of the Contract

  1. Depending on the type of service, the contract is concluded as follows:

  • In the case of services provided directly by the Provider, between the Customer and the Provider.

  • In the case of mediated services, between the Customer and the respective third-party provider; in this case, the Provider acts solely as an intermediary.

For services mediated by Skydive Mission, only the General Terms and Conditions of the respective executing organizer shall apply, unless otherwise stipulated in these GTC.

By booking the experience service, the Customer expressly acknowledges the validity of the GTC of the respective experience partner.

The Customer is obliged to comply with the safety regulations, instructions, and requirements applicable to participation in the experience service.

Rights and obligations relating to execution, liability, withdrawal, cancellation, rebooking, or insurance services are governed exclusively by the GTC of the respective experience partner.

Skydive Mission is not a contractual partner of the actual jump service and assumes no liability for damage, injuries, or other disadvantages resulting from the execution of the experience service. (cf. Part 1, Clause 8)

  1. The presentation of products, services, or offers on the website does not constitute a legally binding offer but merely an invitation to submit an offer by the Customer.

  2. By submitting an order, the Customer makes a binding contractual offer. The Provider may accept this offer within five business days by:

  • sending an order confirmation by email,

  • delivering the ordered goods,

  • issuing an invoice, or

  • performing the service.

  1. If an offer or price indication is incorrect, the Customer will be informed and may freely decide whether to accept the amended offer or withdraw from the contract.

  2. When purchasing vouchers or credit, the version of the GTC valid at the time of redemption shall apply.

3 Prices and Payment Terms

  1. All prices are stated in euros (€) and include statutory value-added tax, plus any shipping or additional costs shown during the ordering process.

  2. The prices stated on the website or on-site at the time of conclusion of the contract shall be decisive.

  3. Incorrect price information may be corrected by the Provider; in such case, the Customer will be informed and may confirm or cancel the order.

  4. Payments are to be made in advance unless expressly agreed otherwise. Accepted payment methods include, in particular, PayPal, credit card, and other payment methods stated on the website.

  5. If the Customer defaults on payment, the Provider is entitled to withdraw from the contract.

  6. Until full payment has been made, the goods remain the property of the Provider (retention of title pursuant to Section 449 BGB).

4 Delivery and Retention of Title

  1. Vouchers and informational material are usually dispatched within 1–2 business days after receipt of payment.

  2. Delivery of other items is subject to availability. The Provider shall not be liable for delivery delays caused by third parties or force majeure.

  3. In contracts with consumers, the Provider retains ownership of the delivered goods until the purchase price has been paid in full.
For entrepreneurs, the goods remain the property of the Provider until all claims arising from the ongoing business relationship have been settled in full.

  4. Video or photo products are edited and delivered with music; there is no entitlement to the release of unedited raw material.

5 Right of Withdrawal

  1. Consumers have the right to withdraw from the contract within fourteen (14) days without giving any reason.

  2. The withdrawal period is fourteen (14) days from the date of contract conclusion or, in the case of the delivery of goods, from the date of receipt of the goods.

  3. To exercise the right of withdrawal, the Customer must inform:

Skydive Mission, Rosa-Luxemburg-Straße 42, 03238 Finsterwalde, Germany
Email: jump@skydivemission.com

by means of a clear statement (e.g., by letter or email) of the decision to withdraw.

  1. Timely dispatch of the withdrawal declaration is sufficient to comply with the deadline.

  2. The right of withdrawal does not apply to:

  • services that have been fully performed at the Customer’s request before expiry of the withdrawal period,

  • goods made to the Customer’s specifications or clearly personalized,

  • unsealed or downloaded software, photo, or video products.

  1. In the event of effective withdrawal, the Provider shall refund received payments within fourteen (14) days. The Customer shall bear the return shipping costs, provided the delivered goods correspond to the order.

  2. The Customer shall be liable for any loss in value resulting from handling of the goods beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

6 Availability, Warranty, and Complaints

  1. If an ordered product or service is unavailable, the Provider is entitled to withdraw from the contract; payments already made will be refunded without delay.

  2. Obvious defects must be reported by the Customer in writing within fourteen (14) days after receipt.

  3. The statutory warranty rights apply (Sections 434 et seq. BGB). The Customer may demand subsequent performance; if this fails, the Customer may withdraw, reduce the purchase price, or claim damages.

  4. Exit altitudes for skydiving services are guideline values and may deviate by up to 30% for safety or weather-related reasons.

  5. Upon receipt, the Customer must inspect deliveries for completeness and damage and report transport damage to the shipping service provider without delay.

7 Data Protection

  1. Personal data are processed exclusively in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

  2. Disclosure to third parties takes place only insofar as this is necessary for performance of the contract or is legally permissible.

  3. With the Customer’s consent, the Provider may use personal data for its own marketing purposes (e.g., newsletters). This consent may be withdrawn at any time with effect for the future.

  4. Further information is available in the privacy policy at:
    https://www.skydivemission.com/privacy-statement

8 Performance of Skydiving Experiences / Relationship to Organizers

  1. [Skydive Mission’s Own Skydiving Services]
Where Skydive Mission itself organizes and conducts skydiving experiences, training, advanced training, or other jumping events, Skydive Mission is the organizer. In these cases, the contract for performance is concluded directly between the participant and Skydive Mission. Only these GTC shall apply.

  2. [Mediated Skydiving Services]
Where skydiving experiences are merely mediated, execution of the experience is carried out exclusively by the respective jump organizer, drop zone operator, or training provider (collectively referred to as the “Organizer”). In these cases, Skydive Mission is not the organizer but acts solely as an intermediary. (cf. Part 1, Clause 2)

  3. By booking or redeeming a voucher for a mediated experience, the contract for performance is concluded exclusively between the participant and the respective Organizer. Skydive Mission owes only the proper mediation.

  4. Only the Organizer’s General Terms and Conditions shall apply to the legal relationship between the participant and the Organizer. These are made available before booking and must be accepted by the participant.

  5. Skydive Mission shall not be liable for the proper performance or quality of services provided by the Organizer. Claims arising from performance must be asserted directly against the Organizer.

9 Liability and Risk in Skydiving

  1. Participation in skydiving of any kind (e.g., tandem jumps, training jumps, licensed jumps, training or advanced training jumps) takes place at the participant’s own risk. The participant is aware that participation involves significant physical risks that cannot be entirely excluded even with the utmost care.

  2. Prior to participation, the participant must carefully read and sign the liability waiver provided by the respective Organizer. Participation is excluded without this declaration.

  3. Liability of the Organizer, its legal representatives, instructors, tandem masters, and vicarious agents is excluded except in cases of intent or gross negligence. This does not apply to damage resulting from injury to life, body, or health caused by negligent breach of duty.

  4. Where Skydive Mission itself is the organizer, the above liability limitations apply accordingly.

  5. Where Skydive Mission acts only as an intermediary, it shall expressly not be liable for damages arising in connection with the execution or consequences of a jump. Claims must be asserted directly against the Organizer.

  6. The participant is obliged to strictly follow all safety instructions of the Organizer, instructors, pilots, and ground personnel. In the event of violations, participation may be refused or terminated without entitlement to a refund.

  7. The participant must inform the Organizer or instructor prior to the event of any health restrictions or other circumstances that could impair jump capability.

  8. Notice on Dangers and Waiver of Liability – particularly for students and licensed jumpers
The participant acknowledges that skydiving, especially off-landings, jumps in difficult terrain, or events abroad, is an extreme sport involving significant risks.
Before participation, a Release of Liability must be signed confirming awareness of risks and waiver of claims for simple negligence.

  9. Insurance and Personal Responsibility
The participant is responsible for obtaining appropriate insurance coverage (e.g., accident, life, health, foreign travel health insurance).

10 Applicable Law and Place of Jurisdiction

  1. The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

  2. If the Customer is a merchant, a legal entity under public law, or a special fund under public law, Bad Liebenwerda shall be the exclusive place of jurisdiction.

  3. For consumers, the statutory jurisdiction provisions apply.

Part 2 – Special Conditions A: Travel, Training & Courses

1 Introduction

The following General Travel Conditions (GTC-Travel) apply to all undertakings and form an integral part of the concluded Skydive Holiday Participant Agreement & Liability Waiver between the Participant and Skydive Mission. In addition, the requirements stated in the respective event descriptions also form part of the travel contract insofar as they concern the personal abilities and characteristics of the Participant for the respective trip.

Skydive Mission offers the organization of skydiving training, tandem jumps, training camps, license courses, and skydiving trips. These do not constitute package travel within the meaning of Sections 651a et seq. of the German Civil Code (BGB). Where third parties (e.g., aircraft operators, drop zones, instructors, accommodations) are involved, the Provider merely acts as an intermediary for their services.

Participants must be of legal age and physically and mentally fit. A medical fitness certificate may be required prior to the start of the course. Safety instructions issued by instructors are binding. Violations may result in exclusion.

Hereinafter, the Participant is referred to as the “Participant”, while “we” or “Skydive Mission” refers to the contracting party.

(For reasons of readability, the simultaneous use of masculine, feminine, and diverse language forms is omitted. All personal designations apply equally to all genders.)

2 Characteristics of the Trips

All training & progression events organized by Skydive Mission are training and advanced training camps, training camps at recognized airfields, or destination & scenic landing events for licensed skydivers in geographically exceptional regions of the world. The events are neither sports, hiking, long-distance, educational, nor package tours in the conventional sense.

These are undertakings essentially focused on airsports, skydiving training, and education and are characterized by an uncertain course and outcome. The destinations generally offer excellent conditions for spectacular airsports experiences; however, some areas are not fully developed in terms of infrastructure. This also applies to tourist infrastructure. Some locations therefore do not meet all Central European standards.

Especially in the case of off-landings in extraordinary landscapes, usual standards cannot be expected and are often significantly undercut. This may affect transfers, route safety, catering, the general security situation, hygiene, medical care, the training standards of local cooperation partners, as well as the degree of difficulty and risk of the undertaking.

Skydive Mission acts solely as an organizer and intermediary and is not liable for the training and services of skydiving instructors, coaches, and load organizers. For third-party services, only the respective provider is liable. The liability provisions of Part 1, Clause 8 apply additionally.

2.1 Requirements for the Performance of Jump Services

The following applies to all jumps:

  • Comfortable, sporty footwear without hooks

  • Appearance in a sober condition (no drugs or alcohol)

  • Normal physical and mental fitness required; any limitations must be disclosed in advance

For AFF training courses or license courses, the maximum body weight is 100 kg.

A voluntary withdrawal by travel or course participants from the training or offered training jumps during the trip shall be deemed as performance rendered by both the organizer (training facility or skydiving instructor) and Skydive Mission. Any refund or credit is excluded.

The following additional requirements apply to tandem jumps:

  • Maximum weight (including clothing) 90 kg, in exceptional cases up to 110 kg only after individual consultation and for a surcharge of EUR 30

  • Minimum height 140 cm, minimum weight 40 kg

  • Minimum age 10 years (for minors, written consent of the legal guardians is required)

2.2 Transportation

If motorized means of transport are used during the trip, the Participant should not have high expectations regarding comfort and safety. In most cases, locally customary means of transport are used (e.g., rental cars, buses, railways, etc.).

2.3 Route Safety

Some destinations are only accessible by air or with great difficulty. It is therefore common to move away from paved and secured paths. Wilderness, deserts, and other challenging or potentially dangerous areas are included and must be taken into account in expectations.

Skydive Mission is not a local tour operator or officially recognized tour guide for the regions to which destination & scenic landing events lead.

2.4 Accommodation

Each Participant is free to organize accommodation independently on site. In some cases, local cooperation partners recommend accommodations that Skydive Mission forwards to the Participants. Depending on the nature and destination of the trip, these accommodations vary significantly—sometimes intentionally.

Some trips focus on adventure, others on comfort. Unless otherwise stated, Participants may generally assume that accommodation will be in proper shared lodgings. Skydive Mission endeavors to provide gender-separated accommodation where possible. Local standards apply in this respect as well.

2.5 Catering

During the trips, Participants are generally responsible for their own catering. As a rule, grocery stores or dining options are located near the accommodations and drop zones. Local food must always be expected. Nutritional supplements or special products required by a Participant must be procured independently and in sufficient quantity prior to departure.

2.6 Medical Care

On all trips, Skydive Mission carries a travel pharmacy and a first-aid kit. Minor injuries can be treated on site.

For jumps at official drop zones, proximity to hospitals and prompt professional medical care is generally available. However, for trips with planned off-landings, professional medical personnel are not present on all tours. Professional medical care cannot be guaranteed in remote regions.

This also applies to initial treatment, rescue, evacuation, and medical transport in emergencies. In addition to the travel pharmacy, a telephone is always available to contact emergency services if sufficient network coverage exists.

2.7 Training Standards of Local Cooperation Partners

With regard to aviation personnel, Skydive Mission cooperates with entrepreneurs who, at their own discretion, comply with the respective national and usually also international standards.

The selection of partners is based on previous experience. Often, local specialists are used who have experience in the relevant area. A separate suitability test in the form of licenses or similar documentation is not carried out.

2.8 Degree of Difficulty and Risk in Skydiving

Skydiving is an extreme sport and involves particular risks. If it does not clearly emerge from the event description on the website which physical and psychological requirements are to be expected, the Participant must consult in advance with a responsible team member.

Skydive Mission is available at all times for informational consultations. Participants must be aware that every skydiving event may involve above-average physical and psychological strain. The information and requirements stated in the event description on the website and in the respective FAQs are binding.

Location-specific risks are also described there and must be acknowledged by the Participant. The general risk of everyday life also applies to events mediated by Skydive Mission; however, special effects may arise due to jumps in sometimes remote regions.

3 Skydive Holiday Participant Agreement & Liability Waiver

The contract between the Participant and Skydive Mission is concluded once Skydive Mission, after thorough discussion of all relevant aspects and after assessing motivation and suitability, offers participation and the Participant accepts this offer.

Skydive Mission reserves the right to unilaterally terminate the contract if the participation fee has not been paid in full or if doubts arise regarding the Participant’s suitability for the respective trip (cf. Part 2, Clause 11).

4 Payment

Upon receipt of the participation confirmation, the Participant is obliged to immediately pay the required deposit. This step is necessary as Skydive Mission makes advance payments to partners on site.

The amount of the deposit depends on the booked services:

  • General Skydive Event Participant: EUR 500

  • Skydive Event Participant with participation in wind tunnel camp and/or additional skydiving courses: EUR 1,250

The remaining balance is payable no later than on the first day of the event at the meeting point before the start of the adventure, without further request, unless Skydive Mission has canceled the trip pursuant to Clause 10 due to failure to reach the minimum number of participants.

In this case, the remaining balance does not become due, and the deposit paid is refunded immediately.

If the Participant is unable to make the payments or anticipates that participation will not be possible, Skydive Mission must be informed immediately. Otherwise, the place may be allocated to another Participant and the contract terminated.

5 Scope of the Trip

From the event description on the website, these GTC, and the Skydive Holiday Participant Agreement & Liability Waiver, which the Participant receives separately by email upon booking confirmation, it follows to what extent Skydive Mission is obliged to provide the described services as the conditions of the respective tour permit in order to offer the Participant an unforgettable experience.

Both the event description and these GTC as well as the Skydive Holiday Participant Agreement & Liability Waiver must be read carefully. In case of questions, the Participant may contact Skydive Mission at any time.

6 Changes to Services on Site

Uncertainties due to geographical conditions or other circumstances are an integral part of all trips organized by Skydive Mission.

The Participant must be aware that the nature and course of the trip, in particular the skydiving activities, may change if the local situation or weather conditions so require. Flexibility and team spirit are essential components of the shared adventure and influence the selection of Participants.

This applies in particular to trips where off-landings in remote areas are planned or where a skydiving event is being carried out for the first time.

In addition to geographical uncertainties, force majeure, natural disasters, loss of equipment, conflicts with the local population, official orders, revocation of landing rights or means of transport, as well as illnesses or injuries of Participants or team members may lead to changes.

Deficient infrastructure, unforeseeable circumstances, breakdowns, or technical necessities—e.g., weather-related—may also make adjustments necessary.

These changes may affect almost all areas: accommodation, catering, transport, or route. In extreme cases, the declared travel or skydiving and/or licensing objective may not be achieved or the trip may be terminated prematurely.

According to Skydive Mission, such changes do not constitute a travel defect but form part of the adventure character of the trip. No claim for a refund of the participation fee arises as a result.

6.1 Route

Route adjustments may become necessary at any time, for example if paths are blocked or access is denied. Accordingly, certain locations may not be reachable.

6.2 Rescheduling of Travel Days

Due to the factors mentioned, time shifts may occur. Participants should therefore allow for at least three buffer days when planning their return journey to avoid problems.

6.3 Transported Equipment

Transporting equipment may lead to difficulties with importation (e.g., drones, radios, GPS devices, or parachute equipment).

Participants carrying their own skydiving equipment (especially rigs with Automatic Activation Devices – AADs) should inform themselves about the respective airline and entry regulations prior to departure. These may vary depending on country, airport, and airline.

Loss of baggage may also result in not all equipment being available in time.

6.4 Key Personnel

It may occur that shortly before the start of the trip, key personnel such as instructors, pilots, or guides are injured or drop out for other reasons. In this case, Skydive Mission reserves the right to carry out the tour nevertheless, provided suitable substitutes are available.

7 Participation Obligations of the Participant

The Participant is obliged to prepare carefully and independently for the upcoming trip. This includes in particular:

  • researching safety and entry requirements of the respective country,

  • preparing for behavior in dangerous situations,

  • ensuring sufficient physical and psychological fitness.

The Participant is also expected to actively participate in the joint organization and to keep informed about current developments prior to departure. Communication usually takes place via a dedicated WhatsApp group.

Respectful interaction and willingness to cooperate are fundamental prerequisites for participation. This also includes at all times following the instructions of skydiving instructors, instructors, or guides fully and without restriction. Pilots, skydiving instructors, and guides are experts in their respective fields and decide according to the situation.

8 Withdrawal by the Participant

The Participant may withdraw from the contract at any time before the start of the skydiving adventure. For organizational reasons, the withdrawal should be made in writing.

As Skydive Mission makes advance payments to partners on site, a full refund of the participation fee does not take place. Instead, flat-rate cancellation fees are retained.

The amount retained generally corresponds to the deposit paid and depends on the booked services (cf. Part 2, Clause 4).

This also applies in the event of a no-show, meaning the Participant does not arrive in time at the place of the event or course start, whether due to missing time buffers or other circumstances. In this case, there is no entitlement to a refund of the remaining participation amount.

9 Termination Due to Force Majeure

Skydive Mission may withdraw from the contract if unforeseeable events of force majeure significantly endanger the safe execution of the trip or make participation impossible. The Participant has the same right.

Skydive Mission decides at its own discretion whether the participation fee is refunded, credited toward a future trip, or whether an alternative adventure is offered. As a rule, the tour is postponed to the same period of the following year.

Additional costs, e.g., for return travel, accommodation, or catering, are to be borne by the Participant. Skydive Mission recommends taking out travel cancellation insurance.

The assessment is made taking into account the expertise of Skydive Mission and the local organizers.

10 Cancellation Due to Failure to Reach the Minimum Number of Participants

Skydive Mission may withdraw from the contract if the minimum number of participants stated in the event description is not reached. Unless otherwise stated, the minimum number of participants is 20 persons.

Withdrawal must be declared to the Participant no later than 30 days before the start of the trip. If it becomes apparent at an earlier stage that the minimum number will not be reached, the withdrawal declaration shall be made without delay.

In this case, the remaining balance of the trip price does not become due, and payments already made shall be refunded immediately and in full.

11 During and Prior to the Trip

If, despite express warning, the Participant violates the participation obligations (cf. Part 2, Clause 7), disobeys the instructions of the organizers or instructors, or repeatedly behaves disrespectfully toward other Participants, this shall be deemed a breach of contract.

In such cases, Skydive Mission may terminate the contract, exclude the Participant from the group, and retain the total price of the adventure. Any evacuation or additional early return travel costs shall be borne by the Participant.

This also applies if the Participant already attracts negative attention during preparation. The participation fee will be refunded; there is no claim for damages.

12 Refunds and Special Costs

All services organized and provided by Skydive Mission (e.g., equipment) are deemed rendered even if the Participant does not make use of them.

If special costs arise for the Participant which Skydive Mission initially covers, the Participant is obliged to reimburse these amounts in full.

13 Limitation of Liability

Skydive Mission plans and organizes all trips with due care. The liability provisions of Part 1, Clause 8 apply.

14 Transfer of Contract

Until the start of the trip, the Participant may request that another person enters into the travel contract and takes over the place. Skydive Mission may object to this transfer if the person does not meet the special requirements of the booked skydiving activities or if legal provisions or official orders oppose participation.

Even if Skydive Mission consents, the original Participant and the entering person shall be jointly and severally liable for payment of the travel price.

15 Voucher Conditions

15.1 Value Vouchers against Payment

The skydive event travel voucher is purchased at face value or at a lower value. It is valid for three years from the end of the year of issue and can be redeemed only once. An extension is excluded. The voucher is transferable to other persons, and commercial resale is permitted.

15.2 General Voucher Conditions

The voucher is freely transferable; however, the transferee must meet the participation requirements. Participation in a skydive event trip requires a minimum level of personal suitability (e.g., health condition, fitness). The original voucher holder is obliged to inform the transferee of the GTC-Travel and the voucher conditions. Skydive Mission reviews suitability prior to participation. A voucher does not replace the selection process. A refund of the purchase price does not take place if physical or psychological requirements are not met.

Vouchers cannot be combined with other vouchers. All vouchers are value vouchers and may be redeemed for all skydive offers of Skydive Mission; excluded are skydive equipment, service maintenance, merchandise articles, and goods available in the online shop.

Exchange or cash payment is excluded. Remaining balances are credited toward further adventures.

16 Commercial Use of Content

Content created during a Skydive Mission adventure may only be used commercially with the consent of Skydive Mission.

Content is deemed commercial in particular if the person wishing to use the content has a reach of more than 10,000 persons in social or traditional media.

Any marketing or sale of content created during an adventure to third parties is prohibited unless express permission has been granted. Content includes texts, images, videos, and experience reports.

17 Limitation Period

Claims of the Participant pursuant to Sections 651c to 651f BGB arising from injury to life, body, or health caused by intentional or negligent breach of duty by Skydive Mission, its legal representatives, or vicarious agents shall become time-barred after one year.

Claims for compensation for other damages shall also become time-barred after one year, provided they are based on intentional or grossly negligent breach of duty.

The limitation period begins on the day following the contractual end of the event. If the last day falls on a Saturday, Sunday, or a public holiday, the deadline shall be extended to the next business day.

Negotiations between Skydive Mission and the Participant regarding claims shall suspend the limitation period until one party refuses to continue the negotiations. The limitation period shall not begin earlier than three months after the end of the suspension.

18 Choice of Law and Jurisdiction

18.1 Choice of Law

The contractual relationship between the Participant and Skydive Mission shall be governed exclusively by German law.

18.2 Legal Consequences

Where German law is not applied abroad, German law shall nevertheless apply exclusively to the legal consequences—particularly the type, scope, and amount of claims.

18.3 Place of Jurisdiction

Skydive Mission may be sued only at its registered office.

18.4 Legal Actions by Skydive Mission

For legal actions brought by Skydive Mission against the Participant, the Participant’s place of residence shall be decisive.

18.5 Jurisdiction for Participants Abroad

For actions against Participants who are merchants, legal persons under public or private law, or resident abroad, the registered office of Skydive Mission shall be agreed as the place of jurisdiction.

18.6 Limitations

The above provisions shall not apply if:

a) mandatory international provisions applicable to this agreement provide more favorable rules for the Participant, or
b) mandatory provisions of a Member State of the European Union to which the Participant belongs provide more favorable rules.

Final Provisions

Any amendments or additions to these General Terms and Conditions must be made in written form. Should any provision be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
